A Kyle man is behind bars after authorities say he kidnapped, beat and raped an ex-girlfriend last week, according to court documents and Hays County jail records.
Oscar Calderon, 43, was arrested Sept. 26 and charged with aggravated kidnapping, aggravated sexual assault and strangulation. The kidnapping and sexual assault charges are first-degree felonies; the strangulation charge is a third-degree felony.
The alleged 38-year-old victim told police she called Calderon from her parent’s phone to discuss issues she was having with her children. During the course of their phone conversation, Calderon convinced the victim to go to a billiard’s bar in Austin, according to court documents.
The victim told police Calderon picked her up at her south Austin home in a Red Dodge Ram Pickup bearing Mississippi plates, Calderon’s arrest affidavit stated.
The victim told police Calderon became intoxicated that night and allegedly slapped the victim in the face, at which point she asked to be taken home, the affidavit said. Once in Calderon’s truck, during the drive, the victim told police Calderon continued to assault her by punching her in the face and body.
The woman, who did not have a phone, pleaded with Calderon to stop assaulting her and to take her home, the affidavit said. Calderon refused, and instead took her to his Kyle home in the 700 block Skyview Terrace.
When the two arrived, the victim told police she refused to get out of the vehicle. That’s when Calderon continued assaulting her, punching her throughout her body until she agreed to go inside his residence, the affidavit said.
Once inside the home, Calderon took her to his bedroom and allegedly raped her, according to the affidavit. The victim told police that after she had been sexually assaulted, Calderon then began strangling her. The victim said she had difficulty breathing and “felt like things became fuzzy,” the affidavit said.
Once Calderon let her go, the victim said she grabbed his truck keys and drove back to her home and changed her clothes. The woman told police she later called Calderon and advised him where his truck was located. She then called Austin police to report the incident.
A Hays County Sheriff’s deputy was dispatched to St. David’s Hospital in Austin where he interviewed the victim in an emergency room. The deputy reported observing a “pea” size red mark on top of the victim’s nose and a “dime” size scratch on her wrist, according to the affidavit.
The woman’s right wrist also appeared swollen, as well as her face around both eyes, though no bruising was visible, the deputy said in the affidavit.
Calderon is being held in the Hays County Jail under a $475,000 total bond on the three charges.
