The Kyle Police Department is expected to file charges against the owners of four dogs that were involved in a June 11 attack in the Waterleaf Subdivision.
According to a City of Kyle press release, the Kyle Animal Control Office is finalizing a criminal investigation against Albandydia Mercado-Cruz, 37, and Daniel Vera, 49. The Kyle ACO are expected to foward a charge of Attack by Dog, a felony violation of the Texas Health and Safety Code, to the Hays County District Attorney's Office.
The ACO is also filing charges with the Kyle City Prosecutor for failure to properly register the dogs with the city, as is required by city ordinance.
On Wednesday, Mercado-Cruz was arrested for failure to appear in court regarding a citation issued on May 31 for dogs running at large. Cruz is currently being held at the Hays County Jail pending a bond hearing.
Charges stem from the incident on June 11 when four pit-bull mixed breed dogs owned by the two escaped from their fenced back yard in the 100 block of Cushman Drive.
The dogs then attacked a woman and her dog that were walking along Cushman Drive at around 6 a.m. that morning. The woman was transported to an Austin hospital for treatment of her injuries. Her dog died during surgery for its injuries at an Austin area veterinanrian clinic.
The four pit-bull mixed breed dogs were voluntarily surrendered to the ACO shortly after the attack. The dogs were euthanized and were sent for rabies testing. The test returned negative for rabies.
