No means no: Sexual assault suspect claims victim was playing hard to get

Seven months after an alleged 2012 sex offense, a victim reported to police that a Buda man she knew forced himself on her after having consensual sex with him earlier in the day. 


Ian Andrews, 18, accused of sexual assault, a second-degree felony, for a crime he allegedly committed when he was 17, was arrested Feb. 20 by the Hays County Sheriff’s Office. 


The alleged victim told police that despite having consensual sex with Andrews on Aug. 26, 2012, later in the day during a second sexual encounter, she said she was an unwilling participant, according to court documents. 


The victim told police during an interview on March 20, 2013, that she was visiting Andrews at his Buda residence – seven months prior – to help him complete various tasks around the home. 


After taking a break from the chores, the two retreated to Andrews’ room to engage in consensual sex, the victim told police according to court documents. 


Afterwards, Andrews and the victim continued working around the home. Then, the two once again retreated to Andrews’ bedroom where he began allegedly groping her at the foot of the bed, according to the victim’s testimony in court documents. The victim told police she made it clear to Andrews that she did not want to have sex again, the documents state. 


The victim said Andrews continued to grope her and eventually pushed her down onto the bed, kissing her and removing articles of her clothing, despite being told “no,” the victim is quoted as telling investigators. 


The victim then said Andrews began engaging in unprotected sex with her, something they have done before, though this time the victim said she continually told the suspect “no” and “please stop,” according to court documents. Andrews was apparently unresponsive to her pleas, the documents state. 


“(The victim) indicated that Mr. Andrews told her that he thought she was just playing hard to get,” the documents state. 


In an April 2, 2013 interview, Andrews told investigators he did not recall the incident the victim was referring to, court documents state. But, he did state that he did hear the victim say “no,” but he though she was “playing hard to get,” according to the documents.


The victim told investigators she became upset, distant and began to tear up after the alleged offense. She said Andrews asked what was wrong, to which she responded that she did not want to have sex again, court documents state. 


Andrews was released from jail on Feb. 21 on a $30,000 bond for the sexual assault offense. He was also arrested on Feb. 20 for warrants on three Class C misdemeanors. Hays County court records show this was Andrews’ first arrest.
