A Hays County Grand Jury indicted a San Antonio man last month with breaking into a home with intent to commit a sex crime, the fourth such indictment handed down to the 23-year-old in an apparent months-long crime spree in San Marcos.
Jonathan Matthew Porterie is accused of breaking into homes with intent to commit sexual offenses in four separate instances in 2012. Court documents state at least two of the cases took place in San Marcos, though all four occurred in Hays County.
Porterie also has been charged with an aggravated assault with a deadly weapon in San Marcos, though he has not been indicted in that case.
On Dec. 18, a Grand Jury indicted Porterie with a first-degree felony of “intentionally or knowingly enter a habitation, without the effective consent of (the victim), the owner thereof, attempted to commit or committed the felony offense of Improper Photography.” That alleged crime took place on September 15, 2012, and no further details were available in court documents.
Last year in January, a Grand Jury indicted Porterie on three separate counts of entering a home without permission with the intent to commit sexual assault, according to court documents. At least two of those cases occurred in San Marcos, including at an apartment complex geared toward college students.
In one of the cases, Porterie is accused of inappropriately touching a female victim while she was sleeping in her bedroom on Sept. 1, 2012. The victim told police the contact by a nude Porterie, who was in her bed, was “unwanted, offensive, and caused her to believe she was being assaulted,” according to court documents. The victim began yelling causing Porterie, whom was a friend of her roommate, to flee to the victim’s roommate’s room, gather his clothing and leave the apartment, court documents state.
The alleged crime took place at the University Club Apartments in San Marcos. According to the apartment complex’s website, they feature four-bedroom townhomes, each with its own bathroom and tenants have individual leases by the bedroom.
In a separate case, a female victim told police she woke up to Porterie sexually assaulting her on Nov. 4, 2012, according to a probable cause affidavit. It is not clear how the two knew each other, but court documents state that the victim knew the suspect to be Porterie.
Probable cause affidavits were not available for the August 15, 2012, and September 7, 2012, burglary of habitation with intent to commit sexual offense cases.
Porterie is also accused in a January 2011 aggravated assault with a deadly weapon, where he allegedly impeded a female victim’s breathing by choking her with his hands, courts documents state. The victim told police Porterie pushed her onto/over a railing and began strangling her with both hands, nearly causing here to lose consciousness. An uninvolved person came to her rescue and pulled Porterie off of her, allowing her to remain conscious and continue breathing, court documents state.
Porterie has not been indicted on that case. An indictment is a formal charge or accusation, and does not signify guilt. A person is presumed innocent until proven guilty in a court of law.
Porterie has been in Hays County custody since his Nov. 6, 2012 arrest, and is being held on a $770,000 bond. Court records show he is set for a jury trial on March 17 for the three felony indictments handed down on Jan. 23, 2013. As of Monday, no trial date had been set for his Dec. 18 indictment.
