Two months after a Kyle man died near a well-traveled intersection in an auto-pedestrian accident, authorities are still awaiting forensic reports from the Texas Department of Public Safety to move forward with any potential charges.
Phillip Duran’s autopsy concludes that the 37-year-old died “as a result of multiple blunt force injuries sustained when struck by a motor vehicle.” No alcohol or drugs were detected in Duran’s body, the report shows.
Kyle Police believe a Hays High student may have struck the victim near the Kohler’s Crossing and FM 1626 intersection. Authorities seized the student’s vehicle and DPS is conducting a forensic analysis of the car and of auto parts found near the scene.
Duran’s family has said he set out on a late night run on April 27 and never returned home. Duran’s brother, then a Kyle Council candidate, Chad Benninghoff, found the deceased body during a search of the area.
Kyle Police Chief Jeff Barnett said his detectives also interviewed about a dozen witnesses or those thought to have pertinent information about the case.
Barnett said his office is awaiting DPS reports before presenting the case to the District Attorney, who will then decide whether to file charges on the suspect.
