Kyle police nab suspect on the run

Kyle police arrested a man on Monday who they say was involved in a downtown disturbance, ignored officer’s attempts to intervene, drove recklessly through residential neighborhoods and hit a parked car as he evaded arrest more than a week ago.


Roy Davila, 24, had been on the run since the Nov. 22 incident. He was arrested at his job at Phillips gas station in San Marcos.

Police Chief Jeff Barnett said Davila was involved in a physical disturbance with a woman who was crying for help near the Centerfield Sports Bar.  


Barnett said Officer Juan Bazaldua was in the police department’s parking lot when he heard screams for help coming from a woman, whose identity has not been released, near the Center and Main Street intersection at about 5 a.m. 


Bazaldua responded to the disturbance in progress and observed Davila approach a white 2000 Ford Expedition, according to court documents. When the officer attempted to make contact with Davila, he ignored authorities, entered his car and drove away through downtown streets around City Hall.  


Noticing Davila drive through stop signs and almost colliding with stationary vehicles on Center Street waiting for the train to pass, Bazaldua “immediately activated my emergency lights and sirens in attempts to detain the vehicle.”


“The vehicle refused to stop and accelerated through the residential area,” Bazaldua said in court documents. “A pursuit ensued through the city limits of Kyle. The vehicle was observed traveling recklessly through much of the residential area,” even colliding with a parked BMW on a private driveway on N. Burleson Street.


Davila then drove westward on FM 150 headed toward Driftwood, and once several miles outside of Kyle, the suspect stopped his vehicle and ran into a heavily wooded area, according to Barnett. 


Bazaldua chased Davila on foot toward an unknown residence when he lost sight of him and then reportedly heard “what appeared to be the arming of a shotgun.”


Immediately, Bazaldua said in court documents, he returned to his cruiser and called for back up.


Kyle police officers and Hays County Sheriff’s Deputies arrived to assist with the help of a canine unit to help track the fleeing suspect. A request for air support from the Austin Police Department did not happen due to inclement weather, court documents state. 


Davila, who has an extensive criminal record in Hays County dating back to when he was 17-years-old, has been charged with evading arrest, reckless driving and duty upon striking an unattended vehicle, jail records show.


Police have not said whether or not the woman knew or was connected to Davila.


He is being held on $9,000 bond. Barnett said no injuries were reported and there was no damage to city property.
