Alleged rape suspect remains at large

As of noon Tuesday Kyle Police, in conjunction with Austin and Travis County law enforcement, are searching for an Austin man accused of sexual assault.


Nearly two months after the Feb. 10 incident, an arrest warrant has been issued for Angel Hernandez, 21, who authorities say is one of two suspects in the alleged sexual assault of two females at a party on Goforth Road in Kyle.


Uriel Salinas, 20, the other suspect in the case, was arrested March 18 and charged with sexual assault and sexual assault of a child, both second-degree felonies.


One of the alleged victims may have been allegedly raped three times that night, and, according to both victims’ stories, the second victim may have been allegedly raped at least twice, according to Salina’s arrest affidavit.


Hernandez’s attorney told Kyle authorities that his client was going to surrender himself no later than March 25, but the attorney later told police he no longer was representing Hernandez after the suspect would not answer his calls, according to Kyle Police Chief Jeff Barnett.


What was planned to be a night of drinking and partying on Feb. 10 allegedly turned into a scene of rape and violence.


One of the alleged victims, identified as Victim 1 in the arrest affidavit, said she was invited by Salinas to a party at his family’s place on Saturday, Feb. 9. She had met Salinas on facebook.com, where they had been communicating for three months. She knew him by the name of “JayTone,” according to the affidavit.


After the victims arrived at the party at about 11 p.m. Feb. 9, Victim 1 said “she had approximately three bottles of beer and one shot of Jose Cuervo (Tequila) given to her by (Salinas),” according to the affidavit.


“Victim 1 commented she felt unusually intoxicated for the amount of alcohol she had,” the affidavit said.


Victim 2 recounted a similar story and said she, too, “felt unusually intoxicated for the amount of alcohol she had to drink” – three bottles of beer and two shots, according to the affidavit.


Both victims told police that they were unaware if “anything was put” in their drinks, according to the affidavit.


Victim 1 told police that shortly after drinking she “passed out” on a chair in the metal building they were drinking in before being awakened by two unknown male friends of Salinas who offered her a couch in the living room of a light blue trailer, next to the metal building, to lie down on, the affidavit said.


Victim 1 said she observed Victim 2 lying on a mattress in the living room of the trailer. Victim 1 then lay down on the couch and Hernandez sat down at the end of the couch before “scooting closer” and eventually allegedly sexually assaulted her, according to the affidavit.


“Victim 1 advised she tried to push him away, but he held her shoulders and arms down. Victim 1 advised (Hernandez) did not wear a condom and she believes he ejaculated inside of her. During this time, Victim 1 advised Victim 2 was being sexually assaulted by (Salinas) on the mattress on the floor of the living room,” the affidavit said.


But the alleged sexual assaults were only beginning.


Victim 1 said that after the first incidents of alleged rape, the suspects then said, “let’s switch,” according to the affidavit, at which point Salinas grabbed Victim 1 “pulled her by her wrists to a back room of the trailer where (Salinas) threw her onto a mattress.”


Victim 1 described her fight against her alleged attacker, at one point telling him “to get the (expletive) off me,” but to no avail as (Salinas) allegedly continued to sexually assaulted her without a condom, according to the affidavit.


But Victim 1’s alleged trauma was not yet done; she told police (Salinas) then sodomized her, the affidavit said.


Victim 2, who told police she “blacked out” after drinking three beers and two shot said she “doesn’t remember anything except waking up naked on a mattress on the living room floor of the trailer,” according to the affidavit.


Victim 2 could only recall, according to the affidavit, Salinas having sex with her. She also said she thought he had sodomized her, according to the affidavit.


Salinas has been in custody since his March 18 arrest and is being held on a $200,000 bond.


Kyle Police Chief Jeff Barnett said his department has sought the assistance of both Austin and Travis County law enforcement to serve the active sexual assault warrant on Hernandez.
