Rape suspect’s case dropped

A Hays County Grand Jury failed to hand down an indictment against San Marcos resident Gabriel David Matthews at a hearing on June 8, court records show.


Matthews, 42, was charged with aggravated sexual assault in March.


Last week, the Grand Jury examined the case carefully and found there wasn’t sufficient evidence to indict Matthews.


Matthews was arrested March 29 on a charge of aggravated sexual assault. He remained in custody at Hays County Jail on a $100,000 bond. Matthews was facing a state jail felony.


Matthews mother, Clyde-Linda Matthews, said her son was falsely accused of sexual assault by a friend of his who was jealous about seeing him with another girl.


The woman, whose age was not disclosed, told police that she was with Matthews in the living room of a San Marcos home where he allegedly raped her, according to the arrest affidavit.


“She got angry about seeing him with that other girl and wanted to hurt him, so she called the police and made the whole thing up,” Clyde-Linda said.


Gabriel Matthews was released from the Hays County Jail on June 15.


“It made us so happy that he was freed,” Clyde-Linda said. “But he was in jail for 75 days and his reputation has been hurt.”


She also said that Gabriel has been ill since being incarcerated and is under a doctor’s care.


“He can’t sleep,” she said. “He’s been so sick.”


Clyde-Linda said she is considering pressing charges against the alleged victim for a false report.


“Gabriel has never had any negative dealings with police before this,” she added. “We’re from New Orleans, and he never had any trouble before moving to San Marcos.”


Matthews was also arrested in July on a charge of improper photography without consent and tampering with a witness. No court date has been set for that incident.
