Village at Kyle owners file for Chap. 11

SCC Kyle Partners, Ltd. the owners of the Village at Kyle, have filed for Chapter 11 bankruptcy protection.


According to court documents, the Austin based company filed for Chapter 11 at the end of August. Chapter 11 provides for reorganization, usually involving a corporation or partnership. A chapter 11 debtor usually proposes a plan of reorganization to keep its business alive and pay creditors over time. People in business or individuals can also seek relief in chapter 11.


The Village at Kyle is a 215-acre mixed-use development located at the northeast intersection of FM 1626 and IH 35. The development includes a shopping center with Lowe’s Home Improvement, Walgreen’s, Seton Hospital Hays and AT&T to name a few.


SCC specializes in retail development, brokerage and tenant representation, it also lists other clients including Boston Market, Home Depot, Pier 1 and Carmax.


Scott A. Deskins is listed as company president and general partner on the court documents. The documents show that the company owes the Hays County Appraisal District $458,934 in property taxes. SCC also lists other debtors, including TexasEcoGrow, Libby Simonson and SCC Kyle Lot 1-J, Ltd.


Last month, the Austin Business Journal reported that Wal-Mart has purchased a section of the land.


SCC is being represented by Austin law firm Hohmann Taube & Summers LLP.


Calls to the developers and the attorneys were not returned.
