Police arrested a 23-year-old Kyle man who allegedly raped a 26-year-old woman whom he invited to his birthday party, police say.
At about 9 p.m. on August 4, police were called out to a delayed sexual assault, in which the victim stated that Martin Vargas raped her as she slept off a night of drinking, an affidavit used to secure an arrest warrant says.
Vargas allegedly entered the extra bedroom of his friend’s house where the victim, also a guest at the home, was asleep on a bed. The victim awoke to Vargas raping her, according to the affidavit.
When interviewed by police in late August, Vargas admitted that he did take advantage of the victim due to her level of intoxication, the affidavit says. Vargas was arrested Sept. 13 and remains in Hays County Jail on a $75,000 bond, jail records show.
