HAYS COUNTY — Following the postponement of any action on the item during the last meeting, the Hays County Commissioners Court unanimously approved a development agreement on June 6 for Mission Oaks Condominiums between the county, Davy Crockett Estates, LLC and Lang Family Ranches L.P.
The development is anticipated to consist of approximately 28 single-family condominium units, while the maximum number of units permitted is 35. Davy Crockett is permitted to create seven additional units within Mission Oaks Condominiums, but in the event the company elects to create additional units, the agreement must be amended, according to agenda documents.
The two tracts involved in the parcel are a 39-acre platted lot known as Silver Spur Ranchettes and 5 acres within the city limits of the village of Bear Creek.
The agreement will serve to exempt the Mission Oaks Condominium regime and its units from platting requirements outlined in the Hays County Development Regulations, while ensuring that development standards from the county’s regulations are met.
Per commissioner Walt Smith’s request, after listening to resident concerns, a section of the agreement was changed to ensure that the county has not limited too many rules that apply to Lot 5 and that it should be broad enough to allow any rule the village of Bear Creek has applied to the lot.
As stated in the approved agreement, Davy Crockett shall re-plat or subdivide Lot 5 of Bear Creek Oaks, Section III in accordance with the village of Bear Creek’s subdivision requirements and obtain required approval for the subdivision plat for Lot 5 from the village of Bear Creek prior to imposing the declaration on Lot 5.
“I believe what’s written now does accommodate that request,” said General Counsel Mark Kennedy. “I think it’s broad enough to cover that.”
While the item was originally brought up during the May 23 meeting, some residents are still concerned about issues including traffic associated with the construction of the development.
“If someone would take a look at the very end of Davy Crockett [Drive], where this development is going to be installed, you will see that the roadway will not support construction traffic. It won’t support any other sort of traffic and it’s going to need to be repaired,” said William Wagner during the public comment section of the item. “Two-million dollar homes, if someone’s looking at it, they are not going to accept that roadway in there. My concern is, if it’s not addressed now, it’s going to become a taxpayer expense to correct it before the private roads are installed in that development.”
Smith thanked the staff members who were involved in the discussions of the agreement, as the county has only been doing development agreements for a short amount of time.
“This has probably been the longest DA that we have negotiated. As y’all know here on the court, we just started doing these about 18 to 24 months ago to really get a handle on how we can have an impact on some of these developments that otherwise, we wouldn’t have an impact on,” he said. “It’s been a work in progress for quite some time and I know the staff hours that went into it were monumental so I appreciate it.”
