On Tuesday night, Dripping Springs City Council made a unanimous motion to authorize staff and legal counsel to file an appeal related to the trial court opinion on the SOS v. TCEQ matter.
The trial was filed by Save Our Springs Alliance (SOS) against the Texas Commission on Environmental Quality (TCEQ), who granted the city of Dripping Springs a permit authorizing the discharge of up to 822,500 gallons per day of treated municipal wastewater into Onion Creek in Hays County.
SOS stated with evidence that releasing treated municipal water will lower the quality of the Onion Creek waters and will affect their “fishable” and “swimmable” quality.
Judge Maya Guerra Gamble reversed TCEQ’s order and urged Dripping Springs from taking actions in unlawful agency order.
On Tuesday night, council members went into Executive Session to discuss the matter and briefly came back to present their decision to file an appeal. Dripping Springs council will revisit the motion during their next meeting on Nov. 10.
