In Kyle, the initiative to discourage people from illegally using fireworks is aptly named "You Light It, We Write It," meaning that anyone caught using fireworks within the city limits will be ticketed by police.
As stated on the city's website,
"It's unlawful for any person to manufacture, assemble, store, transport, receive, keep, offer to another or to otherwise have possession with the intent to sell, use, discharge, cause to be discharged, ignite, detonate, fire or otherwise set to action any fireworks of any description, except under special permit as authorized by the city or in the fire code adopted by the city. Any person in violation of this ordinance in the city of Kyle may be charged with a class C misdemeanor. Fines can be as high as $2,000. "
Fireworks are likewise not allowed in the cities of Buda, Wimberley, Mountain City and San Marcos.
In Buda, the restriction extends to within 5,000 feet of the city limits (extraterritorial jurisdiction). Violation of Buda's fireworks ordinance carries a fine not to exceed $500, with each occurrence being a separate violator.
For those who live in areas where fireworks are permitted, the Hays County Fire Marshal has the following tips:
Buy from permitted fireworks sellers only and never attempt to make your own fireworks Read and follow label directions, warnings and safety instructions. Always have an adult supervise fireworks activities. Parents don't realize that young children suffer injuries from sparklers. Sparklers burn at temperatures of about 2,000 degrees - hot enough to melt some metals. |
Never try to re-light or pick up fireworks that have not ignited fully Light fireworks one at a time, then move back quickly. You should never twist fuses together to shoot off more than one at a time. Never carry fireworks in a pocket or shoot them off in metal or glass containers. After fireworks complete their burning, douse the spent device with plenty of water from a bucket or hose before discarding it to prevent a trash fire. |

Check the weather and don’t discharge fireworks on days of high wind and/or low humidity. Do not discharge fireworks on or over grass or any other material that will burn.
Only discharge fireworks on your property or with written consent of the landowner.
Fireworks may only be sold from: June 24th – July 4th Independence Day.
February 25 – March 2 Texas Independence Day.
April 16 – April 21 San Jacinto Day.
The last Wednesday before the last Monday of May through Memorial Day.
December 20 and runs through midnight, January 1.
