25-year-old Kyle resident Krystle Concepcion Villanueva was indicted March 15 by a Hays County Grand Jury for one count of Capital Murder of a Child and one count of Aggravated Assault with a Deadly Weapon - Family Violence in the death of her daughter and assault against her father-in-law in January. According to a press release, the indictment states that on Jan. 5, 2017, Villanueva "intentionally or knowingly cause(d) the death of an individual under 10 years of age ... by cutting and stabbing" five-year-old Giovanna Larae Hernandez with a deadly weapon. It also states Villanueva "intentionally, knowingly, or recklessly cause(d) serious bodily injury to Eustorgio Arellano," on the same day. See the original story here.
The indictment reads as follows:
COUNT I - CAPITAL MURDER OF PERSON UNDER TEN
On or about the 5th day of January, 2017, in Hays County, Texas, the Defendant, Krystle Concepcion Villanueva, did then and there"intentionally or knowingly cause(d) the death of an individual under 10 years of age ... by cutting and stabbing" the said G.H. with a deadly weapon, to wit: a knife or other sharp implement;
COUNT II - AGGRAVATED ASSAULT WITH A DEADLY WEAPON – FAMILY VIOLENCE
On or about the 5th day of January, 2017, in Hays County, Texas, the Defendant, Krystle Concepcion Villanueva, did then and there intentionally, knowingly, or recklessly cause serious bodily injury to Eustorgio Arellano by cutting and stabbing him with a knife, and the defendant did then and there use or exhibit a deadly weapon, to-wit: a knife, during the commission of said assault, and the said Eustorgio Arellano was then and there a member of the Defendant’s family or household,
The District Attorney’s Office is making no further comment on the case at this time, other than to say that some aspects of the investigation remain ongoing, and no decision on whether or not to seek the death penalty has been made at this time.
