A 19-year-old Kyle resident faces multiple charges following a short standoff with a Buda police officer, police say.
Devin Fox was arrested July 23 for aggravated assault of a public servant, a first-degree felony, when he refused to put down a pistol he had just stolen, Buda Police Chief Bo Kidd said.
At about 4:40 a.m., officer Alex Fernandez witnessed a shirtless Fox wandering the Bradford Village subdivision. When Fernandez stopped his patrol car he saw Fox reach for an unknown object in his front pocket. Fernandez asked Fox to stop walking but he refused. The officer then pointed a spotlight on Fox, which caused him to scurry and hide behind shrubs near a home, Kidd said.
Fernandez reported that the object in Fox’s hand appeared to be a pistol and he advised him to give up. Almost a minute later, Fox complied and surrendered, Kidd said.
“He was lucky that he wasn’t shot,” Kidd said.
When Fox had his pockets emptied, several electronics and pairs of sunglasses and a handgun were discovered. Fox admitted to the officer that he had broken into vehicles, Kidd said.
The next day, police received a report from a resident that the 9mm handgun and some of the other items found on Fox had been taken from his truck in the 200 block of Bradfield Drive, Kidd said.
Besides the aggravated assault charge, Fox was arrested for theft of a firearm, a state jail felony, and theft from a vehicle, a Class A misdemeanor. As of Tuesday, he remains in custody at the Hays County Jail on bonds worth $58,500, court records show.
