Two Hays County men charged with intoxication manslaughter
In separate incidents, two Hays County men were arrested for intoxication manslaughter during the Easter holiday weekend, authorities say.
On early April 24, Michael Solis, 30, hit and killed an elderly pedestrian as he attempted to cross the south access road in the 1500 block of Interstate 35 in San Marcos, police said.
Solis, of San Marcos, was allegedly drunk when he struck 81-year-old Sabino Cortez, of Kerrville, around 3 a.m. with his vehicle, San Marcos Police Chief Howard Williams said.
Williams said that Cortez suffered from dementia and had wandered from a nearby hotel, where his family was staying for the holiday.
According to court records, Solis had previously been arrested for drunk driving at least two other times. In one of those incidents, he was also charged with striking a highway fixture.
In another accident, around 1 a.m. on April 23, Stephen Marmolejo, 39, of Wimberley, was killed when he was ejected from the bed of a pickup that had rolled over along FM 2325 near Wimberley. The driver, Andrew Spalding Rogers, 29, was later charged with intoxication manslaughter.
In the incident, Rogers, also a Wimberley resident, lost control of his 2004 Ford pickup and then overcorrected, causing the truck to roll over, according to a Department of Public Safety official.
Rogers was arrested for drunk driving in 2000, and in 2007, he was charged with striking a highway fixture and failure to stop and render aid, court records say.
Both men remain in Hays County Jail on $100,000 bonds. Intoxication manslaughter is a second-degree felony punishable by two to 20 years in prison.
Time served for child sex offender
Dustin McFall, the Kyle man who fled to Mexico with a 14-year-old male runaway, was sentenced to time served as part of a plea agreement with prosecutors.
22nd District Judge Charles Ramsay imposed the sentence on Thursday. He will also pay a $2,000 fine and register as a sex offender for the rest of his life. McFall pled guilty last month to two counts of sexual assault of a child, a second-degree felony.
Circumstances surrounding the McFall case led to the firing of former Kyle Police Officer Karl Cranek after questions arose over whether he properly investigated the scene when he found McFall in the boy’s company shortly before they absconded across the border.
Buda man arrested for knife, golf club assault
A 28-year-old Buda man was arrested last week for allegedly using a knife to stab and also a golf club to strike his brother while at their Ruby Ranch home, court records show.
Hays County Sheriff’s Office deputies were called out to the residence in the 100 block of Creekside on April 15 and discovered the weapons along with smears of blood in one of the bedrooms, an affidavit used to secure an arrest warrant says.
According to the report, Edgar Campos-Vargas aggressively entered the room of Nicholas Allen, also 28, where he and William Kaufman were studying for a firefighter’s exam. Campos-Vargas allegedly hit Allen over the head with a chair and then grabbed a large knife and stabbed the left side of Allen’s body, the affidavit says.
Then wielding a golf club, Campos-Vargas, the adopted brother of Allen, chased Allen to his room and struck him in the head with the club, causing him to lose his hearing. Campos-Vargas also proceeded to smack Allen in the back of the head with a blender, the affidavit, written by Det. Angelo Floiran, states.
Kaufman escaped the house and ran to a neighbor’s home to notify police. Allen was transported to Seton Medical Center Hays with non-life threatening injuries. Campos-Vargas was also sent to the hospital for a seizure he suffered after the attack, the affidavit says.
Campos-Vargas has been charged with aggravated assault with a deadly weapon, a second-degree felony, punishable by two to 20 years in prison. He was arrested Thursday and released from Hays County Jail on Saturday under a $3,000 cash bond, records show.
Buda man arrested over indecent photos at party
A 46-year-old Buda man was arrested last month for improper photography without consent while at a coworker’s party in March, authorities say.
Rosendo Rosales allegedly placed his cell phone underneath a table and snapped photos of a female coworker as she sat across from him, according to an affidavit used to secure an arrest warrant.
A friend of the victim noticed Rosales taking photos of the woman during her party in the 200 block of Harthung Cove on March 19. When Rosales left his phone on a table, the victim and her friend browsed through the images and saw two photos of her, which her friend deleted, the affidavit, written by Buda Police Officer William Kuykendall, says.
Later, the victim saw Rosales place his cell phone underneath a table as he sat across from her. When Rosales left his cell phone on the counter and fell asleep on the couch, the victim and her friend grabbed his phone again and saw that he had taken four photos of the victim’s waistline that showed her skirt and underwear. Her friend deleted these images as well, the affidavit says.
Rosales was booked into Hays County Jail on April 20 and released the same day on a $3,500 bond, jail records show. Improper photography without consent is a state jail felony.
