Lehman student to attend US Naval Academy

A 43-year-old San Marcos man will serve 15 years in prison for the sexual assault of an underage family member over a period of several years, court records show.


Jesus Capetillo Rodriguez was sentenced Feb. 16 by 22nd State District Judge Charles Ramsay after he pled guilty to three counts of sexual assault of a child, all second-degree felonies. Rodriquez received 15 years for each count, however, each sentence will run concurrently.


Prosecutors had abandoned four additional counts, which included aggravated sexual assault of a child, court officials say.


In an affidavit used to secure an arrest warrant, Rodriguez admitted to authorities that he had inappropriately touched a 16-year-old family member numerous times since she was 10 or 11-years old.


The victim came forward in December 2009 after her family spent the Thanksgiving holiday at Rodriguez’s home in San Marcos. Rodriguez stated that he entered the room where she was sleeping and touched the victim inappropriately. He stopped because one of the other kids in the room began to awaken and he didn’t want to get caught, according to the affidavit from Hays County Sheriff’s Det. Eugene Carranza.


The next day, when the victim’s parents were not present, Rodriguez said that he took the girl into his bedroom, where he attempted to have sexual intercourse with her, the affidavit states.


Rodriguez also stated that he could not recall how many times he had sexual contact with the victim, but said that it happened regularly while she was at his home.


The victim stated in the affidavit that she did not tell her mother of the sexual contact out of fear that she would get angry with her. Rodriquez also had threatened the victim, saying that he would get mad at her if she told anyone.


As part of his punishment, Rodriquez will also have to register as a sex offender once he is released from prison.


In an unrelated case, two men have been arrested in connection with an attempted sexual assault of another man last summer, authorities say.


Kyle resident Nathan Michael Williams, 23, and Javier Meza, 26, of New Braunfels, were each charged with the second-degree felony in the June 12 incident. Both remain in Hays County Jail on $35,000 bonds. Meza also faces a charge of engaging in organized crime, a third-degree felony.


According to the indictment, the two men acted together to try to force sex with a 23-year-old male. Both men have pre-trial hearings scheduled this month.
